By accessing and using our services, you agree to comply with and be bound by the following Terms and Conditions. These terms govern your use of our website(s), services, and pay-as-you-go billing system, and are intended to ensure a clear understanding of our mutual responsibilities.

Our services include the hosting of game servers, pay-as-you-go billing with fixed hourly rates, and related technical support. We reserve the right to modify these Terms and Conditions at any time, so we encourage you to review them periodically. Continued use of our services constitutes your acceptance of any changes.

These Terms and Conditions should be read in conjunction with our Privacy Policy and any other relevant legal documents, such as our Legal Notice, which together form the basis of your agreement with us. If you do not agree to these Terms, please refrain from using our services.

By using our website and services, you acknowledge that you are at least 18 years old, or have the consent of a parent or legal guardian, and that you are legally capable of entering into binding contracts.

  1. Services Provided

    1. LBC Hosting (Les Bras Casses) offers a variety of hosting services designed to meet the needs of gamers, developers, and communities. Our services use a flexible pay-as-you-go model with fixed hourly rates for allocated resources. The following outlines the main services we provide:

      1. Game Server Hosting. We offer game server hosting for a wide range of popular games. Our servers are designed to provide a reliable, high-performance environment for hosting multiplayer games. You can select the game title, server specifications, and the duration of service based on your needs. Servers are available for instant setup and are fully customizable to meet your requirements.

      2. Website Hosting. We provide hosting solutions for websites of various sizes and complexities. Our website hosting services include the necessary infrastructure to run your site efficiently, with options for different performance levels based on your needs.

      3. Application Hosting. We offer specialized hosting for applications such as Discord bots and other web applications. These services are designed to ensure reliable performance and uptime for your applications.

      4. Virtual Private Servers (VPS). For users requiring more control over their hosting environment, we provide VPS solutions with guaranteed resources on shared infrastructure and enhanced flexibility for various use cases.

      5. Pay-As-You-Go Billing. Our billing system charges fixed hourly rates for allocated resources. You only pay for the hours your services are available. Billing occurs at the end of each month for all hours used during that period.

      6. Flexible Service Plans. We provide flexible service plans that do not require long-term commitments. Our billing options are based on actual usage, meaning you pay only for what you use, whether it is hourly or daily. This allows you to scale your resources according to your specific needs and budget.

      7. Server Management & Configuration. We offer tools for managing and configuring your servers. These include custom control panels and user interfaces that enable you to modify settings, install necessary software, and manage user access. Our services also allow for easy server backups and configuration restores to ensure your data is safe.

      8. Technical Support. We provide technical support for users encountering issues with their servers. Support is available through our helpdesk or customer service channels, and our team is dedicated to resolving issues related to server performance, setup, and maintenance. We aim to ensure minimal downtime and assist users with any technical difficulties they may experience.

      9. Service Uptime and Performance Guarantees. We strive to provide high levels of server uptime and performance. Our uptime commitments, service credit eligibility, and support response time targets are detailed in our Service Level Agreement (SLA). While we make every effort to maintain a stable and reliable service, we commit to addressing any performance-related issues promptly and ensuring that users have the best possible experience.

      10. Data Hosting Location. All hosting services are provided through data centers located within the European Union to comply with GDPR and local data protection regulations. The hosting locations are designed to offer optimal performance, security, and scalability for our users.

  2. Pricing and Payments

    1. At LBC Hosting (Les Bras Casses), we aim to provide transparent, flexible, and competitive pricing for all of our hosting services. Our pay-as-you-go model uses fixed hourly rates for allocated resources, with monthly billing.

    2. Our services use a pay-as-you-go model with fixed hourly rates for allocated resources. You are billed monthly for the hours used, with payment due within 14 days of receiving your invoice. This flexible system allows you to adjust resources as needed without long-term commitments.

    3. We offer a pay-as-you-go pricing model with no long-term commitments. The cost of services depends on the server specifications and resource requirements (CPU, RAM, storage). Prices are calculated based on hourly rates for allocated resources, and users are only charged for the hours their services are available.

    4. Prices for our hosting services are subject to change, but any price changes will be communicated to users at least 30 days in advance of implementation. Users will always have the option to cancel or adjust their service before any new pricing takes effect. Since we operate without long-term commitments, you are free to create a new server or service using any of our other available offerings if you choose not to accept the new pricing.

    5. We accept the following payment methods: PayPal, Revolut, Credit/Debit Cards, Apple Pay, and Google Pay.

    6. Payments are processed securely via Stripe, our primary payment processor. All transactions are subject to Stripe's terms and conditions, and LBC Hosting is not responsible for payment processing issues or fees beyond the service fees for hosting.

    7. Services are billed monthly based on hourly rates for allocated resources. At the end of each month, you will receive an invoice detailing your usage and charges. Payment is due within 14 days of receiving the invoice.

    8. Payment Terms and Service Suspension:

      1. Monthly invoices are generated at the end of each billing period and payment is due within 14 days of the invoice date. If payment is not received within this grace period:

        1. You will receive payment reminder notifications at 7 days, 3 days, and 1 day before the payment deadline.

        2. If payment is not received by the end of the 14-day grace period, your services (server, website, application, or VPS) will be suspended.

        3. Once suspended, you will receive an email notification informing you of the suspension and providing instructions for making payment to resume service.

        4. Services can be resumed immediately upon payment of the outstanding balance.

        5. If payment is not received within 14 days after service suspension, your server and all associated data will be permanently deleted, and you will receive a notification confirming the deletion.

        6. Once a service has been deleted, no data is recoverable through our systems.

    9. Product Deprecation and Discontinuation:

      1. Occasionally, we may need to deprecate or discontinue specific products or services due to technological advancements, changes in requirements, or infrastructure updates. When a product is deprecated:

        1. The product will be marked as "deprecated" and will no longer be available for new purchases.

        2. Existing users of the deprecated product will receive an email notification informing them of the deprecation status.

        3. When it becomes necessary to completely discontinue a deprecated product, we will initiate a deletion procedure with the following timeline:

          1. You will receive an initial notification 3 months prior to the scheduled discontinuation date.

          2. Subsequent reminder notifications will be sent at 30 days, 15 days, 7 days, 3 days, and 1 day before the discontinuation date.

          3. On the scheduled discontinuation date, the server and all associated data will be permanently deleted, and you will receive a final confirmation email.

    10. We provide billing adjustments and credits under certain conditions. If you are dissatisfied with our services or experience technical issues that cannot be resolved within a reasonable timeframe, you may request billing adjustments. Any adjustment requests will be reviewed on a case-by-case basis.

    11. Failure to pay for services may result in the suspension of your account or services until payment is received. LBC Hosting reserves the right to charge a late fee if applicable, as specified in the service agreement. We may also take additional steps to recover any overdue payments, including restricting access to your account.

    12. All prices are exclusive of taxes, unless otherwise stated. Taxes applicable to your purchase, including VAT (Value Added Tax) or any other indirect taxes, will be calculated at the time of payment based on the applicable tax rates in your jurisdiction.

    13. Minimum Payment Amount: To ensure sustainable service provision, there is a minimum payment threshold. This minimum covers essential costs including payment processing fees, technical support, infrastructure maintenance, and service delivery. Invoices below this threshold will be carried forward to the next billing cycle until the minimum payment amount is reached. The current minimum payment amount is displayed at checkout and in your account dashboard.

  3. Billing Adjustments and Credits

    1. At LBC Hosting (Les Bras Casses), we operate on a pay-as-you-go model where you are billed monthly for the resources you have already used. Since you only pay for services that have been consumed, traditional refunds do not apply to our billing model.

    2. However, we may provide billing adjustments or account credits in the following circumstances:

      1. Service Unavailability: If your services experience downtime due to issues on our end, we will not charge you for the hours during which the service was unavailable. This adjustment will be automatically applied to your monthly invoice.

      2. Technical Issues: If your service experiences technical issues that cannot be resolved and significantly impact your ability to use the service, we will credit your account for the affected hours.

      3. Billing Errors: If there is an error in billing, such as being charged incorrectly or being overcharged for services, we will correct the invoice and adjust your charges accordingly.

    3. To request a billing adjustment or report an issue, please contact our customer support team at [email protected] with the following information:

      1. Your account details (email address, username)

      2. A description of the issue

      3. The affected time period and services

      4. Any relevant screenshots or supporting evidence

    4. Once we receive your request, our team will review it and notify you of the outcome. We aim to respond to billing adjustment requests within 14 days of submission.

    5. Important Notes:

      1. Since our model is pay-as-you-go, you cannot request refunds for services already consumed.

      2. Credits or adjustments will be applied to your next invoice or as a reduction in your current month's charges.

      3. Billing adjustment requests must be submitted within 30 days of the service issue to be considered.

    6. Credits or adjustments will not be provided for:

      1. User errors or dissatisfaction due to personal preferences.

      2. Services that have been used for purposes that violate these Terms and Conditions.

      3. Planned maintenance windows that have been communicated in advance.

    7. LBC Hosting reserves the right to update or modify this policy at any time. Any changes will be communicated through our website or by email to users.

  4. User Responsibilities and Fair Use Policy

    1. By using the services provided by LBC Hosting (Les Bras Casses), you agree to comply with the following responsibilities and obligations. These responsibilities are designed to ensure a positive experience for all users and to maintain the integrity and security of our services. Failure to comply with these responsibilities may result in account suspension or termination.

    2. You agree to use our services in full compliance with all applicable local, national, and international laws, rules, and regulations. This includes but is not limited to laws regarding intellectual property, data protection, and online behavior. You are solely responsible for ensuring that your use of our services does not violate any laws.

    3. You agree to use our hosting services exclusively for lawful, personal, or business purposes, in accordance with the terms of service and our Acceptable Use Policy (AUP). You must not:

      1. Use our servers for any illegal activities, including but not limited to hacking, phishing, spamming, or distributing malware.

      2. Host or distribute any content that violates the intellectual property rights of others, including pirated software, copyrighted material, or unlawful content.

      3. Interfere with or disrupt the functionality of our services, including but not limited to excessive resource consumption, denial-of-service attacks, or other harmful activities.

      4. Use our services for any activities that may harm, damage, or disable the server infrastructure, data centers, or network.

      5. Engage in abusive, offensive, or discriminatory behavior toward other users.

    4. Fair Use of Resources: To ensure optimal performance for all users, we have established the following fair use guidelines:

      1. Storage Usage: Each hosting plan includes a specified amount of storage space. You are expected to use this storage space responsibly and only for legitimate purposes related to your specific hosting service. Storage should not be used as a general-purpose file hosting or backup solution unrelated to the service being provided. Users who consistently exceed their storage allocation may be notified and requested to reduce their usage.

      2. Database Usage: Database resources should be used efficiently and responsibly. This includes implementing proper indexing, avoiding unnecessary queries, and optimizing data retrieval methods. We reserve the right to limit database connections or impose temporary restrictions if your database usage negatively impacts system performance or other users' experience.

      3. API Usage: Our API is subject to rate limits to ensure system stability and fair access for all users. Automated, constant, or excessively frequent API calls that appear to be polling for changes are discouraged. Users must not attempt to circumvent these rate limits through multiple accounts or other technical means.

      4. Network and Bandwidth: Activities that consume excessive bandwidth, such as hosting file distribution services, content delivery networks, or streaming services unrelated to your subscribed service, are not permitted. We reserve the right to throttle or limit bandwidth for users who consistently exceed reasonable usage levels.

      5. CPU and Memory: Consistent high CPU usage that appears unrelated to normal operations (such as cryptocurrency mining or general-purpose computing tasks) is not permitted. We reserve the right to temporarily suspend services that consistently use 100% of allocated CPU resources for extended periods if such usage appears to be outside normal operations.

      6. VPS-Specific Guidelines: While VPS services provide greater control over your environment, you must still adhere to reasonable usage standards and avoid activities that may negatively impact our infrastructure or other users. Running services or applications that generate abnormally high load, engage in network abuse, or compromise security is prohibited.

      7. Paste Service Guidelines: Our paste.lesbrascasses.net service is provided exclusively for sharing logs and text content related to LBC Hosting services for troubleshooting and support purposes. The paste service should not be used for sharing content unrelated to our services, for long-term storage, or for any purpose that violates these Terms and Conditions. We reserve the right to remove any pastes that are deemed inappropriate or unrelated to our services.

    5. If excessive or abusive usage is detected, we will take the following graduated approach:

      1. Notification: We will contact you with details of the issue and request that you address it.

      2. Warning: If the issue persists, we will issue a formal warning and may temporarily restrict certain resource usage.

      3. Limitation: Continued violation may result in specific limitations being placed on your account or services.

      4. Suspension: In severe cases of abuse or if previous measures have not resolved the issue, we may temporarily suspend services until the matter is resolved.

    6. You are responsible for maintaining the security and confidentiality of your account credentials, including your username and password. You agree to notify us immediately if you become aware of any unauthorized access or suspicious activity related to your account. You are fully responsible for all activities that occur under your account, whether or not authorized by you.

    7. You agree to pay for all services and associated fees in a timely manner, using the available payment methods. You are responsible for paying your monthly invoices within the 14-day payment period.

    8. While we make every effort to provide reliable and secure services, you are responsible for backing up any critical data stored on your servers. LBC Hosting is not responsible for data loss, corruption, or any other issues arising from the loss of data. It is your responsibility to ensure that your data is regularly backed up to avoid potential data loss. Once a server has been deleted, whether due to product discontinuation or insufficient funds, no data is recoverable through our systems.

    9. You agree not to modify, attempt to modify, or reverse-engineer any part of our services or infrastructure. This includes unauthorized attempts to alter the server configuration or data, install unapproved software, or manipulate the server environment in a way that could affect performance or security.

    10. You agree to communicate with LBC Hosting in a respectful and professional manner. We are committed to providing high-quality support, and we expect users to engage constructively in all interactions with our team. Harassment or abusive behavior toward our staff or other users is strictly prohibited.

    11. You understand and agree that our services are subject to certain limitations, including but not limited to:

      1. Service availability and performance are subject to internet connectivity and infrastructure outside our control.

      2. We may experience scheduled maintenance or unexpected downtime, and we will make reasonable efforts to minimize disruption. However, we do not guarantee 100% uptime.

      3. The ability to modify, upgrade, or extend server resources may be limited based on availability or service capacity.

    12. You agree to respect the rights and privacy of other users. This includes not sharing personal data, including email addresses, usernames, or other sensitive information, without explicit consent. Additionally, you agree not to engage in behavior that could disrupt the experience of others, such as using disruptive or malicious software, or interfering with their ability to use the service.

    13. You agree not to upload, store, or distribute any content through our services that:

      1. Promotes violence, discrimination, or illegal activities.

      2. Harms minors in any way, or is obscene, offensive, or otherwise harmful.

      3. Violates the privacy, intellectual property, or other legal rights of individuals or entities.

      4. Contains malware, viruses, or other harmful code intended to damage or disrupt services.

    14. If you have specific technical requirements that may temporarily exceed the normal usage patterns, please contact our support team in advance to discuss accommodations.

    15. You agree to indemnify and hold harmless LBC Hosting, its employees, directors, and affiliates, from any and all claims, losses, damages, and expenses arising from your breach of these responsibilities or your use of our services. This includes any claims resulting from your actions, content you upload or distribute, and your failure to comply with applicable laws and regulations.

    16. By agreeing to these terms, you acknowledge your responsibility for ensuring the proper and lawful use of our services and agree to uphold these standards throughout your use of our platform.

  5. Account Infractions and Service Suspension

    1. Enforcement Actions. LBC Hosting reserves the right to take appropriate enforcement actions for any violations of these Terms and Conditions, including but not limited to issuing warnings, imposing temporary or permanent restrictions, suspending individual servers, or suspending user accounts entirely.

    2. Notification of Violations. In the event of a policy violation, LBC Hosting may, at its sole discretion, issue an infraction notification to the user. Such notifications shall detail the nature of the violation and any enforcement actions taken. Receipt of such notification requires immediate remediation of the identified violation.

    3. Server Suspension. LBC Hosting may suspend individual services or servers that are used in violation of these Terms. During the suspension period, access to the affected services will be restricted. The duration of such suspension shall be determined by LBC Hosting based on the severity and frequency of the violation.

    4. Account Suspension. For repeated or severe violations, LBC Hosting may suspend a user's account in its entirety. Upon account suspension:

      1. All associated services and servers will be placed in a suspended state

      2. User access to the account will be restricted

      3. The user will be notified via the email address associated with the account

    5. Contestation Period. Following account suspension, users shall have fourteen (14) days from the date of suspension to contest the enforcement action by submitting a formal appeal to the contact email address provided in Section 7. Such appeal must include:

      1. User identification information

      2. Detailed explanation contesting the grounds for suspension

      3. Proposed remediation measures, if applicable

    6. Data Deletion. In the absence of a contestation within the specified fourteen (14) day period, or upon denial of a submitted appeal, LBC Hosting reserves the right to permanently delete all data associated with the suspended account without further notice. The user acknowledges and agrees that following such deletion:

      1. All data will be permanently and irreversibly removed from LBC Hosting systems

      2. No recovery of deleted data will be possible

      3. No compensation shall be due to the user for any deleted data

    7. Immediate Action for Severe Violations. Notwithstanding the foregoing provisions, LBC Hosting reserves the right to take immediate action, including but not limited to immediate account suspension or termination, without prior notice in cases of:

      1. Violations of applicable law

      2. Actions that pose security risks to LBC Hosting systems or other users

      3. Activities that may result in legal liability for LBC Hosting

      4. Any other violation deemed sufficiently severe in LBC Hosting's sole determination

    8. The user acknowledges that LBC Hosting shall be the sole arbiter in determining whether a violation has occurred and the appropriate level of enforcement action.

  6. Limitation of Liability

    1. At LBC Hosting (Les Bras Casses), we strive to provide reliable and high-quality game server hosting services. However, by using our services, you acknowledge and agree to the following limitations and exclusions of liability:

      1. While we make every effort to provide continuous and uninterrupted services, we do not guarantee 100% uptime. Our servers and services may experience interruptions due to maintenance, technical issues, force majeure events, or other circumstances beyond our control. In the event of service downtime, we will make reasonable efforts to restore services as quickly as possible, but we are not liable for any loss, damage, or inconvenience caused by such downtime.

      2. LBC Hosting is not responsible for any loss, corruption, or damage to data stored on your game servers, including data that is the result of server outages, hardware failure, software bugs, or user error. It is your responsibility to regularly back up any important data to ensure that you do not suffer any loss in the event of technical issues. LBC Hosting is not liable for any data loss that occurs during or after your use of our services.

      3. You are solely responsible for any content that you upload, store, or distribute through our services. LBC Hosting does not monitor or control user-generated content and assumes no responsibility or liability for any illegal, offensive, or harmful content. You agree to indemnify and hold LBC Hosting harmless from any claims, damages, or liabilities arising from the content you create or distribute.

      4. To the maximum extent permitted by applicable law, LBC Hosting shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, or data, or business interruption, arising out of or in connection with your use of our services. This applies even if we have been advised of the possibility of such damages.

      5. In the event that LBC Hosting is found to be liable for any damages arising from the use of our services, our liability will be limited to the total amount paid by you for the services in question during the 30-day period preceding the event that gave rise to the claim. In no case will our liability exceed the amount you have paid for the services provided.

      6. LBC Hosting shall not be liable for any failure or delay in performance of our services due to causes beyond our reasonable control, including but not limited to natural disasters, acts of government, telecommunications failures, power outages, labor disputes, or any other events or circumstances that could not have been reasonably foreseen or prevented.

    2. We make no representations or warranties regarding the suitability of our services for your specific needs. Our services are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

    3. LBC Hosting may provide access to third-party services, products, or websites, such as payment processors (e.g., Stripe, PayPal), or other external platforms. We are not responsible for the content, privacy practices, or terms of use of third-party websites or services. Any issues arising from third-party services are outside of our control, and we disclaim any liability related to their use.

    4. If you are dissatisfied with our services or any aspect of the service provided, your sole remedy is to discontinue using the service. You may terminate your account at any time, and we will cease charging you for any future services. No other remedy, including the return of payments or compensation for losses, will be provided.

    5. By using our services, you acknowledge and accept these limitations of liability. If you disagree with these terms, you should cease using our services immediately.

  7. Dispute Resolution

    1. At LBC Hosting (Les Bras Casses), we strive to resolve any disputes or disagreements in a fair and timely manner. We encourage open communication and attempts to resolve issues amicably. However, should a dispute arise regarding our services or the terms of this agreement, the following dispute resolution process will apply:

    2. Before initiating formal dispute resolution, you agree to first attempt to resolve any dispute or claim directly with LBC Hosting by contacting our customer support team. We will make every reasonable effort to resolve your concerns in a satisfactory manner. You may contact us at [email protected] or through our website's support page.

    3. If the dispute cannot be resolved through informal communication within 30 days of first notification, either party may request mediation. Mediation will be conducted by a neutral third party to help both parties reach a mutually acceptable solution. The mediation process shall be conducted in good faith, and both parties agree to share the cost of mediation equally, unless otherwise agreed upon.

    4. If mediation fails to resolve the dispute or if the dispute is not suitable for mediation, either party may initiate binding arbitration. The arbitration will be conducted in accordance with the applicable rules of the French Arbitration Association. The arbitration shall take place in France at a venue nominated by us, and the decision made by the arbitrator will be final and binding on both parties.

    5. This agreement, including any disputes arising from or relating to these Terms and Conditions, shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.

    6. You agree that any dispute or claim arising out of or in connection with these Terms and Conditions will be resolved on an individual basis. You waive any right to participate in a class action, representative action, or collective arbitration, and any claims brought under these Terms and Conditions must be resolved individually.

    7. Notwithstanding the above provisions, either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction if the other party's actions or breach of these Terms and Conditions causes irreparable harm that cannot be adequately remedied by monetary damages.

    8. Any claims, actions, or disputes related to the use of our services must be filed within one year from the date the cause of action arises. After this period, you agree that the claim is permanently waived.

  8. Amendments

    1. LBC Hosting (Les Bras Casses) reserves the right to modify, amend, or update these Terms and Conditions at any time, in its sole discretion. Any changes to these Terms and Conditions will be effective immediately upon posting on our website or notification to you, unless otherwise specified. It is your responsibility to regularly review these Terms and Conditions to stay informed of any updates.

    2. In the event of a material change to the Terms and Conditions, we will make reasonable efforts to notify you, either through direct communication (such as email) or by placing a prominent notice on our website. Continued use of our services after the effective date of any changes will constitute your acceptance of the amended Terms and Conditions.

    3. If you do not agree to the amended Terms and Conditions, you must cease using our services immediately. You may also contact us to request termination of your account or services, in accordance with our cancellation policy.

    4. These amendments will not affect any rights or obligations that have already accrued prior to the effective date of the changes.

  9. Intellectual Property and Takedown Procedure

    1. All content on this website, including text, images, graphics, logos, and software, is the property of LBC Hosting or its respective owners. Reproduction, distribution, or modification of any content without prior written consent is strictly prohibited.

    2. LBC Hosting respects the intellectual property rights of others and expects its users to do the same. If you believe that content hosted on our services infringes your copyright or other intellectual property rights, you may submit a takedown request by contacting us at [email protected] with the following information:

      1. A description of the copyrighted work or intellectual property you claim has been infringed.

      2. A description of where the infringing material is located on our services (including URLs or server details).

      3. Your contact information (name, email address, telephone number).

      4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

      5. A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

    3. Upon receipt of a valid takedown request, LBC Hosting will promptly investigate and, if appropriate, remove or disable access to the infringing material. We will notify the account holder of the takedown and provide them with the opportunity to submit a counter-notice if they believe the content was removed in error.

    4. Users who repeatedly infringe upon intellectual property rights may have their accounts suspended or terminated in accordance with Section 5 (Account Infractions and Service Suspension).
