Terms and Conditions

Welcome to LBC Hosting, your provider of high-quality game server hosting services. By accessing and using our services, you agree to comply with and be bound by the following Terms and Conditions. These terms govern your use of our website(s), services, and pay-as-you-go billing system, and are intended to ensure a clear understanding of our mutual responsibilities.

Our services include the hosting of game servers, pay-as-you-go billing with fixed hourly rates, and related technical support. We may update these Terms, and we give notice before any change that affects your rights takes effect, as described in the Amendments section.

These Terms and Conditions should be read in conjunction with our Privacy Policy and any other relevant legal documents, such as our Legal Notice, which together form the basis of your agreement with us. If you do not agree to these Terms, please refrain from using our services.

You may use our services from the age of 15. If you are under 18, you must have the agreement of a parent or legal guardian, and any paid service must be taken out by them, since a minor cannot be bound by a paid contract on their own. The account holder is the person responsible for the account and for what is paid on it.

Who these Terms apply to. We sell to consumers and to professionals alike, and French law protects consumers more strongly. In these Terms, a consumer is a person acting for purposes outside their trade, business or profession, and a professional is anyone else, including companies and self-employed people acting for their business.

The following clauses apply only to professionals, and never to consumers: the limitation of liability and the exclusion of warranties (Limitation of Liability), and the arbitration, individual-action and one-year time-limit provisions (Dispute Resolution). Where you contract as a consumer, your statutory rights apply in full and nothing in these Terms reduces them. The Consumer Rights section below sets out the rights that are specific to you.

  1. Identity of the Seller

      Where these Terms say "we", "us", "our" or "Les Bras Cassés", they mean the company identified above. The registered office address is also the postal address to use for any written notice, complaint or withdrawal request.

  2. Services Provided

    1. LBC Hosting offers a variety of hosting services designed to meet the needs of gamers, developers, and communities. Our services use a flexible pay-as-you-go model with fixed hourly rates for allocated resources. The following outlines the main services we provide:

      1. Game Server Hosting. We offer game server hosting for a wide range of popular games. Our servers are designed to provide a reliable, high-performance environment for hosting multiplayer games. You can select the game title, server specifications, and the duration of service based on your needs. Servers are available for instant setup and are fully customizable to meet your requirements.

      2. Website Hosting. We provide hosting solutions for websites of various sizes and complexities. Our website hosting services include the necessary infrastructure to run your site efficiently, with options for different performance levels based on your needs.

      3. Application Hosting. We offer specialized hosting for applications such as Discord bots and other web applications. These services are designed to ensure reliable performance and uptime for your applications.

      4. Virtual Private Servers (VPS). For users requiring more control over their hosting environment, we provide VPS solutions with guaranteed resources on shared infrastructure and enhanced flexibility for various use cases.

      5. Domain Name Registration. We register and renew domain names on your behalf through our registrar, OVH. Registration is subject to the rules of the relevant registry. Because a domain is registered immediately and specifically for you, an order cannot be cancelled or reversed once it has been placed. Registering a domain requires your name, postal address, telephone number and email address, and those details are published in the public WHOIS directory as the registrant of record, as the registries require. Domains renew automatically each year unless you disable renewal before the expiry date; we notify you beforehand. You may transfer a domain away at any time using the authorisation code available in your account.

      6. Free Trials. We may offer a free trial on certain services. The duration, the resources included and any limit on how many trials one customer may take are shown when you start the trial. A trial does not convert into a paid service on its own: at the end of the trial period the service is suspended, and it is deleted if you have not chosen to continue on a paid basis. We will not charge you for a trial without your agreement.

      7. Pay-As-You-Go Billing. Our billing system charges fixed hourly rates for allocated resources. You only pay for the hours your services are available. Billing occurs at the end of each month for all hours used during that period.

      8. Flex. Flex is an optional billing mode for services that do not run continuously. Instead of paying for the service around the clock, you pay a fixed monthly amount equal to 30% of the CPU and memory price of your configuration, and then only for the hours the service is actually running. Flex saves you money below roughly 70% uptime and costs you more above it, so it suits a server that is off during the week rather than one that runs permanently. You choose whether to enable it, and the comparison is shown to you before you order.

      9. Dedicated IP. An optional monthly add-on providing an IP address assigned to your service alone. The price is shown before you order.

      10. Flexible Service Plans. We provide flexible service plans that do not require long-term commitments. Our billing options are based on actual usage, meaning you pay only for what you use, whether it is hourly or daily. This allows you to scale your resources according to your specific needs and budget.

      11. Server Management & Configuration. We provide a control panel to manage and configure your services: changing settings, installing software, managing files and controlling who has access.

      12. Backups. The panel includes backup and restore tools, and some services can take backups automatically. These tools are provided to help you, but we give no undertaking as to their availability at any given moment, nor as to the integrity of a restored backup. They do not replace your own copy of anything you cannot afford to lose, and keeping that copy remains your responsibility.

      13. Sub-users. You may invite other people to access a service you own and grant them specific permissions. You remain responsible for what they do with that access, and for removing it when it is no longer needed. Inviting someone does not transfer ownership of the service or the associated billing.

      14. Service Transfers. A service may be transferred to another LBC Hosting account where both parties agree. On transfer, responsibility for the service and for its future billing passes to the new owner. Invoices already issued remain attached to the account that was billed at the time and are not reassigned.

      15. Technical Support. We provide technical support for users encountering issues with their servers. Support is available through our helpdesk or customer service channels, and our team is dedicated to resolving issues related to server performance, setup, and maintenance. We aim to ensure minimal downtime and assist users with any technical difficulties they may experience.

      16. Service Uptime and Performance Guarantees. We strive to provide high levels of server uptime and performance. Our uptime commitment, how unavailable hours are handled, and our support response time targets are detailed in our Service Level Agreement (SLA). While we make every effort to maintain a stable and reliable service, we commit to addressing any performance-related issues promptly and ensuring that users have the best possible experience.

      17. Support Tiers. Support covers our hosting platform and infrastructure and is offered at the following levels:

        1. Standard (included free with every service): platform and infrastructure issues (billing, panel access, outages, account). Target response time of 24 to 48 hours during business hours (Monday to Friday, 10:00 to 18:00 Europe/Paris).

        2. Priority (paid monthly add-on, per server): faster response-time targets and weekend coverage within the same daily window. Response-time targets are detailed in the SLA. It is billed monthly per service and renews automatically. You may cancel it at any time; cover continues to the end of the period already paid for, and is not renewed after that.

        3. Enterprise: custom business-to-business contracts for larger clients, to be made available at a later date, with terms defined per contract.

        One-off, hands-on work outside the scope of regular support (such as migrations, mod or plugin troubleshooting, initial setup, or performance tuning) is provided on a fixed-price basis quoted per support ticket and is not a subscription tier.

      18. Data Hosting Location. All hosting services are provided through data centers located within the European Union to comply with GDPR and local data protection regulations. The hosting locations are designed to offer optimal performance, security, and scalability for our users.

  3. Pricing and Payments

    1. How we bill. Our services are billed by the hour, for the resources allocated to them. You are not asked for anything upfront: at the end of each billing period you pay for the hours you actually used during that period. For readability, prices are presented as a monthly amount, which is what a full month of use costs.

    2. Unavailable hours are not counted. Hours during which your service was unavailable because of a problem on our side are not metered, so they never reach your invoice. There is nothing to claim: you are simply not charged for time your service was not running. This is set out in our Service Level Agreement.

    3. Taxes. Prices shown on our website and in the store are stated excluding tax. Any VAT or equivalent tax due is calculated at checkout by Stripe Tax from the country and tax details you provide, is displayed to you before you confirm payment, and appears as a separate line on your invoice. The total shown on the final confirmation screen is the amount you are charged. Business customers who provide a valid intra-community VAT number may be invoiced without VAT where the reverse charge applies. LBC HOSTING has no intra-community VAT number assigned at present; where no VAT is charged on your invoice, the invoice states the reason.

    4. Minimum billing amount. Because every payment carries a fixed processing cost, we apply a minimum billing amount of 1.00 EUR. It works in two situations:

      1. Where an amount due is greater than zero but below the minimum, it is topped up to the minimum.

      2. Where you cancel a service on which the total ever paid remains below the minimum, the difference is charged at cancellation, so that the service has been paid for at least the minimum over its lifetime.

      3. An order reduced to zero by a discount or a credit stays free. No minimum is applied to it.

      The minimum applicable to you is shown at checkout and in your account dashboard.

    5. Payment method and automatic charging. The payment method you provide at checkout is stored securely by Stripe, our payment processor, and is charged automatically at the end of each billing period. Full card details are never stored on our systems. You can change or remove your payment method from your account at any time; removing it without replacing it will prevent us from collecting what is due and will lead to suspension as described below.

    6. We accept PayPal, Revolut, credit and debit cards, Apple Pay and Google Pay. All payments are processed by Stripe and are subject to Stripe's own terms. LBC Hosting is not responsible for payment processing issues arising on Stripe's side.

    7. Failed payment, suspension and deletion. If a payment fails, we notify you by email and your service is suspended. Suspension stops the service from running but does not delete anything. From that point:

      1. Your files remain downloadable for the whole suspension period, so that you can retrieve your data before any deletion. We recommend you do so as soon as you are notified.

      2. Paying the outstanding amount restores the service immediately.

      3. If the amount remains unpaid 14 days after suspension, the service and all data on it are permanently deleted, and an email confirms the deletion.

      4. Deletion for non-payment also results in a restriction on placing new orders. The restriction does not affect your login, your remaining services or your ability to open a support ticket. It is lifted by our team once the matter is resolved, so if you wish to settle the balance or believe the restriction is a mistake, open a support ticket and we will review your case.

    8. Services you let lapse or cancel. Where a service reaches the end of its term without being renewed, it is suspended and then deleted 4 days later. Where you cancel a service yourself, it stops at the end of the current billing hour and is deleted 7 days later. In both cases your files remain downloadable until the deletion date, and no order restriction is applied.

    9. Once a service is deleted, its data cannot be recovered through our systems. The periods above exist so that you have time to retrieve your data, and we send notice before each deletion. Keeping your own backups remains the safest course.

    10. Price changes. Prices may change, and any change is communicated at least 30 days before it takes effect. You are always free to cancel or adjust your service before the new price applies. Since we ask for no long-term commitment, you may also move to any other offer we publish.

    11. Product deprecation and discontinuation. We may occasionally have to retire a product because of technological change or infrastructure updates. When that happens:

      1. The product is marked deprecated and is no longer available for new orders.

      2. Existing customers are notified by email of the deprecation.

      3. If the product then has to be discontinued entirely, you receive a first notice 3 months before the discontinuation date, followed by reminders at 30, 15, 7, 3 and 1 day. On that date the service is deleted and a final email confirms it.

  4. Billing Adjustments

    1. Because you pay at the end of the period for hours you have already used, there is nothing to refund in the ordinary course: you are never charged in advance for a service you have not received.

    2. Unavailability is handled automatically. Hours during which a service was unavailable because of a problem on our side are not counted, so they do not appear on your invoice and you have nothing to request.

    3. Commercial compensation. Where an incident caused disruption going beyond those unbilled hours, we may grant additional compensation. It is decided case by case, at our discretion, and follows no fixed scale. Granting it once does not create an entitlement for any subsequent incident.

    4. Billing errors. If you have been charged incorrectly, we correct the invoice and adjust the amount. Contact us at [email protected] with your account details, a description of the problem, and the period and services affected. We aim to respond within 14 days.

    5. Requests relating to a specific incident should reach us within 30 days of it, while we still hold the monitoring records needed to check what happened.

    6. These provisions are without prejudice to your statutory rights as a consumer, which are set out in the Consumer Rights section below.

  5. Consumer Rights

    1. This section applies where you contract as a consumer, that is for purposes outside any trade, business or profession. Nothing in these Terms limits the rights it describes.

    2. Right of withdrawal. You have 14 days from the conclusion of the contract to withdraw from it, without giving any reason and without penalty. To exercise it, tell us before the 14 days are up, by any clear statement: an email to [email protected] is enough. You may use the model form at the end of these Terms, but you are not obliged to.

    3. Services that start immediately. Our services are set up as soon as you order, which is normally what you want. When you order, you expressly ask us to begin straight away and you acknowledge that once the service has been fully provided you lose the right of withdrawal for it. If you withdraw while the service is running, you owe us an amount in proportion to what has been provided up to the moment you told us: in practice the hours already used, subject to the minimum billing amount. You owe nothing more than that.

    4. Domain names are excluded. The right of withdrawal does not apply to a domain name registration, because it is performed immediately and produces a registration that is specific to you and cannot be undone.

    5. Statutory guarantees. You benefit from the legal guarantee of conformity for digital services. If a service does not conform to what was agreed, you may require that it be brought into conformity, and where that is impossible or does not happen within a reasonable time, obtain a price reduction or terminate the contract. These guarantees apply free of charge and independently of anything else in these Terms.

    6. Retrieving your data. If the contract ends, for whatever reason, you may retrieve the content you provided or created on your service, free of charge, before it is deleted. Your files remain downloadable for the whole period between suspension and deletion, and we tell you the deletion date in advance. If you need more time or cannot access your files, contact us before that date.

  6. User Responsibilities and Fair Use Policy

    1. By using the services provided by LBC Hosting, you agree to comply with the following responsibilities and obligations. These responsibilities are designed to ensure a positive experience for all users and to maintain the integrity and security of our services. Failure to comply with these responsibilities may result in account suspension or termination.

    2. You agree to use our services in full compliance with all applicable local, national, and international laws, rules, and regulations. This includes but is not limited to laws regarding intellectual property, data protection, and online behavior. You are solely responsible for ensuring that your use of our services does not violate any laws.

    3. You agree to use our hosting services exclusively for lawful, personal, or business purposes, in accordance with the terms of service and our Acceptable Use Policy (AUP). You must not:

      1. Use our servers for any illegal activities, including but not limited to hacking, phishing, spamming, or distributing malware.

      2. Host or distribute any content that violates the intellectual property rights of others, including pirated software, copyrighted material, or unlawful content.

      3. Interfere with or disrupt the functionality of our services, including but not limited to excessive resource consumption, denial-of-service attacks, or other harmful activities.

      4. Use our services for any activities that may harm, damage, or disable the server infrastructure, data centers, or network.

      5. Engage in abusive, offensive, or discriminatory behavior toward other users.

    4. Fair Use of Resources: To ensure optimal performance for all users, we have established the following fair use guidelines:

      1. Storage Usage: Each hosting plan includes a specified amount of storage space. You are expected to use this storage space responsibly and only for legitimate purposes related to your specific hosting service. Storage should not be used as a general-purpose file hosting or backup solution unrelated to the service being provided. Users who consistently exceed their storage allocation may be notified and requested to reduce their usage.

      2. Database Usage: Database resources should be used efficiently and responsibly. This includes implementing proper indexing, avoiding unnecessary queries, and optimizing data retrieval methods. We reserve the right to limit database connections or impose temporary restrictions if your database usage negatively impacts system performance or other users' experience.

      3. API Usage: Our API is subject to rate limits to ensure system stability and fair access for all users. Automated, constant, or excessively frequent API calls that appear to be polling for changes are discouraged. Users must not attempt to circumvent these rate limits through multiple accounts or other technical means.

      4. Network and Bandwidth: Activities that consume excessive bandwidth, such as hosting file distribution services, content delivery networks, or streaming services unrelated to your subscribed service, are not permitted. We reserve the right to throttle or limit bandwidth for users who consistently exceed reasonable usage levels.

      5. CPU and Memory: Consistent high CPU usage that appears unrelated to normal operations (such as cryptocurrency mining or general-purpose computing tasks) is not permitted. We reserve the right to temporarily suspend services that consistently use 100% of allocated CPU resources for extended periods if such usage appears to be outside normal operations.

      6. VPS-Specific Guidelines: While VPS services provide greater control over your environment, you must still adhere to reasonable usage standards and avoid activities that may negatively impact our infrastructure or other users. Running services or applications that generate abnormally high load, engage in network abuse, or compromise security is prohibited.

      7. Paste Service Guidelines: Our paste.lbc.hosting service is provided exclusively for sharing logs and text content related to LBC Hosting services for troubleshooting and support purposes. The paste service should not be used for sharing content unrelated to our services, for long-term storage, or for any purpose that violates these Terms and Conditions. We reserve the right to remove any pastes that are deemed inappropriate or unrelated to our services.

    5. If excessive or abusive usage is detected, we will take the following graduated approach:

      1. Notification: We will contact you with details of the issue and request that you address it.

      2. Warning: If the issue persists, we will issue a formal warning and may temporarily restrict certain resource usage.

      3. Limitation: Continued violation may result in specific limitations being placed on your account or services.

      4. Suspension: In severe cases of abuse or if previous measures have not resolved the issue, we may temporarily suspend services until the matter is resolved.

    6. You are responsible for maintaining the security and confidentiality of your account credentials, including your username and password. You agree to notify us immediately if you become aware of any unauthorized access or suspicious activity related to your account. You are fully responsible for all activities that occur under your account, whether or not authorized by you.

    7. You agree to pay for all services and associated fees in a timely manner, using the available payment methods. You are responsible for paying your monthly invoices within the 14-day payment period.

    8. We provide backup and restore tools, but keeping your own copy of anything critical remains your responsibility, and LBC Hosting is not liable for the loss or corruption of data stored on your services. Before any deletion we give you notice and leave your files downloadable for the whole period leading up to it, as set out in the Pricing and Payments section. Once a service has actually been deleted, its data cannot be recovered through our systems.

    9. You agree not to modify, attempt to modify, or reverse-engineer any part of our services or infrastructure. This includes unauthorized attempts to alter the server configuration or data, install unapproved software, or manipulate the server environment in a way that could affect performance or security.

    10. You agree to communicate with LBC Hosting in a respectful and professional manner. We are committed to providing high-quality support, and we expect users to engage constructively in all interactions with our team. Harassment or abusive behavior toward our staff or other users is strictly prohibited.

    11. You understand and agree that our services are subject to certain limitations, including but not limited to:

      1. Service availability and performance are subject to internet connectivity and infrastructure outside our control.

      2. We may experience scheduled maintenance or unexpected downtime, and we will make reasonable efforts to minimize disruption. However, we do not guarantee 100% uptime.

      3. The ability to modify, upgrade, or extend server resources may be limited based on availability or service capacity.

    12. You agree to respect the rights and privacy of other users. This includes not sharing personal data, including email addresses, usernames, or other sensitive information, without explicit consent. Additionally, you agree not to engage in behavior that could disrupt the experience of others, such as using disruptive or malicious software, or interfering with their ability to use the service.

    13. You agree not to upload, store, or distribute any content through our services that:

      1. Promotes violence, discrimination, or illegal activities.

      2. Harms minors in any way, or is obscene, offensive, or otherwise harmful.

      3. Violates the privacy, intellectual property, or other legal rights of individuals or entities.

      4. Contains malware, viruses, or other harmful code intended to damage or disrupt services.

    14. If you have specific technical requirements that may temporarily exceed the normal usage patterns, please contact our support team in advance to discuss accommodations.

    15. You agree to indemnify and hold harmless LBC Hosting, its employees, directors, and affiliates, from any and all claims, losses, damages, and expenses arising from your breach of these responsibilities or your use of our services. This includes any claims resulting from your actions, content you upload or distribute, and your failure to comply with applicable laws and regulations.

    16. By agreeing to these terms, you acknowledge your responsibility for ensuring the proper and lawful use of our services and agree to uphold these standards throughout your use of our platform.

  7. Account Infractions and Service Suspension

    1. Enforcement Actions. LBC Hosting reserves the right to take appropriate enforcement actions for any violations of these Terms and Conditions, including but not limited to issuing warnings, imposing temporary or permanent restrictions, suspending individual servers, or suspending user accounts entirely.

    2. Notification of Violations. In the event of a policy violation, LBC Hosting may, at its sole discretion, issue an infraction notification to the user. Such notifications shall detail the nature of the violation and any enforcement actions taken. Receipt of such notification requires immediate remediation of the identified violation.

    3. Server Suspension. LBC Hosting may suspend individual services or servers that are used in violation of these Terms. During the suspension period, access to the affected services will be restricted. The duration of such suspension shall be determined by LBC Hosting based on the severity and frequency of the violation.

    4. Store Restriction. For repeated or severe violations, or where a balance remains unsettled, LBC Hosting may restrict an account from placing new orders. A store restriction:

      1. Prevents the ordering, configuration and renewal of new services

      2. Does not suspend your existing services, and does not prevent you from logging in or from contacting support

      3. Remains in place until lifted by our team, and is notified to the email address associated with the account

    5. Support Restriction. Where our support channels are themselves misused, LBC Hosting may restrict an account from opening or replying to support tickets for a stated period. Such a restriction is notified to the email address associated with the account, together with the email address at which it may be contested.

    6. Account Termination. For the most severe violations, LBC Hosting may terminate the account in its entirety, which suspends and then removes all associated services. Termination is notified to the email address associated with the account.

    7. Contestation Period. Following any enforcement action described above, users shall have fourteen (14) days from the date of that action to contest it by submitting a formal appeal to [email protected]. Such appeal must include:

      1. User identification information

      2. Detailed explanation contesting the grounds for suspension

      3. Proposed remediation measures, if applicable

    8. Data Deletion. In the absence of a contestation within the specified fourteen (14) day period, or upon denial of a submitted appeal, LBC Hosting reserves the right to permanently delete all data associated with a terminated account without further notice. The user acknowledges and agrees that following such deletion:

      1. All data will be permanently and irreversibly removed from LBC Hosting systems

      2. No recovery of deleted data will be possible

      3. No compensation shall be due to the user for any deleted data

    9. Immediate Action for Severe Violations. Notwithstanding the foregoing provisions, LBC Hosting reserves the right to take immediate action, including but not limited to immediate account suspension or termination, without prior notice in cases of:

      1. Violations of applicable law

      2. Actions that pose security risks to LBC Hosting systems or other users

      3. Activities that may result in legal liability for LBC Hosting

      4. Any other violation deemed sufficiently severe in LBC Hosting's sole determination

    10. How we decide. Enforcement decisions are taken by our team, on the basis of the evidence available to us and of the rules set out in these Terms and in our Acceptable Use Policy. We act proportionately to what the violation actually is, we tell you what we found and what we decided, and you may contest that decision through the appeal route described above. Our decision is not the last word: it does not affect your right to bring the matter before a mediator or a court.

  8. Limitation of Liability

    1. At LBC Hosting, we strive to provide reliable and high-quality game server hosting services. However, by using our services, you acknowledge and agree to the following limitations and exclusions of liability:

      1. While we make every effort to provide continuous and uninterrupted services, we do not guarantee 100% uptime. Our servers and services may experience interruptions due to maintenance, technical issues, force majeure events, or other circumstances beyond our control. In the event of service downtime, we will make reasonable efforts to restore services as quickly as possible, but we are not liable for any loss, damage, or inconvenience caused by such downtime.

      2. LBC Hosting is not responsible for any loss, corruption, or damage to data stored on your game servers, including data that is the result of server outages, hardware failure, software bugs, or user error. It is your responsibility to regularly back up any important data to ensure that you do not suffer any loss in the event of technical issues. LBC Hosting is not liable for any data loss that occurs during or after your use of our services.

      3. You are solely responsible for any content that you upload, store, or distribute through our services. LBC Hosting does not monitor or control user-generated content and assumes no responsibility or liability for any illegal, offensive, or harmful content. You agree to indemnify and hold LBC Hosting harmless from any claims, damages, or liabilities arising from the content you create or distribute.

      4. To the maximum extent permitted by applicable law, LBC Hosting shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, or data, or business interruption, arising out of or in connection with your use of our services. This applies even if we have been advised of the possibility of such damages.

      5. Professionals only. In the event that LBC Hosting is found to be liable for any damages arising from the use of our services, our liability will be limited to the total amount paid by you for the services in question during the 30-day period preceding the event that gave rise to the claim. In no case will our liability exceed the amount you have paid for the services provided.
