Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") governs the use of all services provided by LBC Hosting (Les Bras Casses). By using our services, you agree to comply with this policy. This AUP applies to all users, including those using game server hosting, VPS, website hosting, and application hosting services.

This policy supplements our Terms and Conditions and should be read in conjunction with them. Violations of this AUP may result in enforcement actions as described in Section 6 below.

  1. Prohibited Activities

    1. You may not use LBC Hosting services to engage in, facilitate, or promote any of the following activities:

      1. Illegal Content and Activities. Hosting, distributing, or facilitating any content or activity that is illegal under French law, European Union regulations, or the laws of the jurisdiction in which you reside. This includes, but is not limited to:

        1. Child Sexual Abuse Material (CSAM) or any content that exploits or endangers minors.

        2. Content promoting or facilitating terrorism, extremist violence, or radicalization.

        3. Content related to human trafficking, forced labor, or exploitation.

        4. Sale or distribution of illegal drugs, controlled substances, or weapons.

        5. Fraud, identity theft, or financial crimes.

      2. Network Abuse. Activities that disrupt, damage, or interfere with the normal functioning of networks, systems, or services, including:

        1. Launching or participating in Distributed Denial of Service (DDoS) attacks.

        2. Operating botnets or command-and-control infrastructure for malicious purposes.

        3. Port scanning, network probing, or vulnerability scanning of systems you do not own or have authorization to test.

        4. Packet flooding, mail bombing, or other forms of network abuse.

      3. Malware and Unauthorized Access. Developing, distributing, or deploying malicious software (viruses, trojans, ransomware, spyware, etc.) or attempting to gain unauthorized access to any system, network, or data, including phishing attacks and credential harvesting.

      4. Intellectual Property Infringement. Hosting, distributing, or facilitating the distribution of pirated software, cracked games, copyrighted material, or any content that infringes upon the intellectual property rights of others without proper authorization.

      5. Spam and Unsolicited Communications. Sending bulk unsolicited emails, messages, or other communications (spam). Operating open mail relays or open proxy servers that facilitate spam transmission.

  2. Resource Abuse

    1. LBC Hosting provides shared and dedicated resources depending on the service plan. To ensure fair access for all users, the following resource usage restrictions apply:

      1. Cryptocurrency Mining. Running cryptocurrency mining software (including but not limited to Bitcoin, Ethereum, Monero miners) is prohibited on all shared hosting services. On dedicated VPS plans, cryptocurrency mining is only permitted if it does not degrade performance for other users and complies with all other terms.

      2. Excessive Resource Consumption. Running processes or applications that consistently consume CPU, memory, storage, or bandwidth in a manner that negatively impacts the performance or stability of services for other users.

      3. Unrelated Workloads. Using game server hosting plans for purposes unrelated to running game servers (e.g., using a Minecraft server plan as a general-purpose compute node, file storage server, or content delivery network).

  3. VPS-Specific Restrictions

    1. While VPS services provide greater flexibility and control, the following additional restrictions apply:

      1. TOR Exit Nodes. Operating TOR exit nodes on our infrastructure is prohibited. TOR relay nodes (non-exit) may be permitted on a case-by-case basis with prior written approval.

      2. Open Proxies and VPNs for Abuse. Operating open proxy servers or VPN services designed to facilitate illegal activities, evade law enforcement, or mask the source of abusive traffic is prohibited.

      3. Unlicensed Gambling. Hosting gambling platforms or services that operate without the required licenses under applicable law.

      4. Adult Content. Hosting adult content that is accessible to minors or that violates French law. Adult content that is legal and properly age-gated must comply with all applicable regulations.

  4. Content Standards

    1. All content hosted on or distributed through LBC Hosting services must comply with the following standards:

      1. Hate Speech and Discrimination. Content that promotes hatred, violence, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic is prohibited.

      2. Harassment and Threats. Content that harasses, threatens, intimidates, or bullies individuals, including doxxing (publishing private personal information without consent), is prohibited.

      3. Exploitation of Minors. Any content that exploits, endangers, or sexualizes minors in any way is strictly prohibited and will result in immediate account termination and reporting to relevant authorities.

      4. Misinformation and Deception. Content designed to deceive or defraud, including impersonating other individuals or organizations, or coordinated inauthentic behavior intended to manipulate public opinion, is prohibited.

  5. User Responsibilities

    1. As a user of LBC Hosting services, you are responsible for:

      1. Ensuring that all content and activities on your services comply with this AUP, our Terms and Conditions, and all applicable laws.

      2. Maintaining the security of your account credentials and access methods. You are responsible for all activities that occur under your account.

      3. Promptly addressing any security vulnerabilities or abuse originating from your services when notified by LBC Hosting.

      4. Monitoring the activities of any sub-users, guests, or third parties who access your services.

  6. Enforcement

    1. LBC Hosting reserves the right to take enforcement action against any user who violates this AUP. Enforcement actions are proportional to the severity and frequency of the violation:

      1. Minor Violations (first offense, low impact): Written warning with a 48-hour correction period. The user is expected to remediate the violation within this timeframe.

      2. Moderate Violations (repeated offenses, significant impact): Service suspension until compliance is achieved. The user will be notified and must demonstrate remediation before services are restored.

      3. Severe Violations (illegal content, CSAM, serious security threats, active attacks): Immediate account termination without prior warning. LBC Hosting may also report the activity to relevant law enforcement authorities as required or permitted by law.

    2. LBC Hosting may, at its sole discretion, bypass the graduated enforcement process and take immediate action when a violation poses an imminent threat to our infrastructure, other users, or the public.

    3. Users whose accounts are terminated for severe violations are permanently prohibited from creating new accounts or using LBC Hosting services.

  7. Reporting Abuse

    1. If you become aware of any activity on LBC Hosting services that violates this AUP, we encourage you to report it to us. You can report abuse by contacting us at [email protected].

    2. When reporting abuse, please provide as much detail as possible, including:

      1. The nature of the violation.

      2. Any relevant URLs, IP addresses, server details, or evidence.

      3. Your contact information (optional, but helpful for follow-up).

    3. We aim to acknowledge abuse reports within 24 hours and will investigate all reports promptly. Reports involving illegal content, CSAM, or imminent threats will be prioritized and addressed immediately.

  8. Amendments

    1. LBC Hosting reserves the right to modify this AUP at any time. Material changes will be communicated through our website or by email with at least 30 days notice before taking effect. Continued use of our services after the effective date of changes constitutes acceptance of the updated policy.
